Live Cover Stallion Service Contract

Subject to the following conditions:
1. The breeding season shall begin February 15th and end July 15th. During the term of the breeding season, the farm will diligently try to get the mare in foal.
2. The mare owner has satisfied themselves that the farm is competent and its facilities adequate for the caring of the owner's mares and foals.
3. Accidents happen. If the owner cannot be contacted in a timely manner, the farm or veterinarian has the owner's full authority and release to perform any medical procedures, administer medication and perform any and all activities necessary to insure the mare's well-being while at the farm at the owner's expense.
4. If for any reason the mare does not settle in foal, the farm, its personnel, and veterinarian will be held harmless.
5. Should the above named stallion die or become unfit or unavailable for service, the mare owner may select another stallion standing at JG Appaloosas with all breeding fees paid applied to that stallion's breeding fee. Mare owner is responsible for paying the difference in stud fees if a stallion is chosen with a breeding fee of higher value. If stallion is chosen with a lower stud fee, the difference will be refunded.
6. Mare owner shall have the right of return for the above named stallion's service in the next breeding season, and in the third breeding season if necessary, when:
A. Mare does not settle in foal
during the present breeding season.
B. Mare is examined in foal but becomes barren during gestation.
C. Mare produces a live foal that is unable to stand and nurse, and subsequently dies.
In all cases, a veterinary certificate will be required.
If the mare should become unbreedable or if the mare should die before producing a live, healthy foal, the mare owner may substitute another mare with permission from JG Appaloosas.
7. JG Appaloosa Sport Horses also gives an unconditional guarantee. If for ANY reason the mare owner is not satisfied with the resulting foal, JG Appaloosas will breed the mare back FREE, (excluding any veterinary, shipping charges, etc...), during the current years breeding season, or return the breeding fee. The mare owner has the choice of rebreeding or refund. The mare owner must notify JG Appaloosas within 30 days of foaling of impending return and deliver the unsatisfactory foal to the farm at time of weaning.
8. The mare must have a current negative coggins test before arrival at the farm. All vaccinations and worming must be up to date.
9. Open mares - mares that have been bred in prior years, but do not have a foal at foot, must have a negative uterine culture. Maiden mares - mares that have never been bred , and mares nursing a foal do not need a culture. A culture can be done here at the farm and in most cases the mare can still be bred on the same heat cycle. Mare owner will be responsible for vet charges.
10. The mare must be safe, manageable and easy to catch.
11. If available, a copy of the mare's registration papers must accompany this contract.
12. In the event that after the mare's arrival to the farm, the farm decides due to the mare's health, condition, or for any other reason it wishes not to continue working with the mare, the farm reserves the right to notify the owner to substitute another mare or refund the deposit, less board and veterinarian expenses and therefore cancel this contract.
13. There exists a clear and present danger at all times to the life and safety of animals of owner and farm, while they are at the farm, and each party agrees to hold the others harmless from any and all actions arising from injury, sickness, or death to any animals or persons arising from their presence at the farm.
14. The terms of payment for the stallion service shall be as follows: a non-refundable booking fee of $250.00 shall accompany this signed agreement to the farm and a balance of $_______ shall be paid before the mare leaves the farm.
15. All board and veterinary expenses will be billed to the owner monthly and is to be paid in full prior to the mare leaving the farm.
16. No mare will be accepted at the farm without a signed contract.
17. The mare owner plans to breed the mare during the month of ___________ and agrees to notify the farm of the exact arrival date at least two days in advance. Any changes are to be agreed upon by both the owner and the farm.
18. Mare care is $8.00 per day without a foal and $12.00 a day with a foal. This includes a box stall and private paddock.
19. A breeders certificate will be issued by JG Appaloosas upon report of a live foal and all other conditions and liabilities of this agreement have been met.
20. When both parties have signed this agreement it will then be a binding contract on both parties. Subject to the above terms and conditions.
